Counter-Notification
If you believe that your content that was removed or to which access was disabled is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or pursuant to law, to post and use the material, you may send a counter-notice containing the following information to our copyright agent:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the courts in the location where you reside or, if outside the United Kingdom, for any judicial district in which olvarix may be found
- A statement that you will accept service of process from the person who provided notification of the alleged infringement
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, olvarix has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our service and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Processing of Notices
Upon receipt of a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the content provider, member, or user that we have removed or disabled access to the material
- Take reasonable steps to promptly notify the alleged infringer of the complaint
If we receive a valid counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. The original complainant will then have ten business days to notify us that they have filed legal action relating to the allegedly infringing material. If we do not receive such notification, we may restore the material.
False Claims
Please note that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or blocked by mistake or misidentification, may be subject to liability.
Educational Purpose Exception
As an educational platform for social casino game development, certain content may be used for instructional, commentary, or critique purposes. Such uses may constitute fair use under copyright law. All DMCA notices will be evaluated in this context.
Modifications to Policy
olvarix reserves the right to modify this DMCA Policy at any time. We will notify users of any material changes by posting the new policy on this page with an updated revision date.
